R10000 bail for rape-accused cop

The fact that one is granted bail is no indication of the outcome of a trial‚ a magistrate has cautioned a police officer accused of rape.

Magistrate Ndivhuwo Sethusha addressed the suspended police officer in the Randburg Magistrate’s Court in Johannesburg on Thursday as she granted him bail.

The 45-year-old sergeant‚ who cannot be named because he is accused of a sexual offence and has not yet pleaded‚ faces one charge of rape.

He allegedly raped a woman being detained in the police cells at the Linden police station in Johannesburg last month.

Prosecutor Nicoli Roscher read out a document in court confirming that the officer was suspended from the police service on June 28‚ 2015.

Roscher said the state supported bail but with restrictions.

Sethusha said she had to consider that the accused was in a position of power as a police officer and was trusted to uphold the law.

“Regardless of you having been accused of rape‚ you have no previous convictions so there is nothing to tell the court that you are a violent person should you be granted bail‚” Sethusha said.

His bail was set at R10000 and he was warned not to make contact the with victim and witnesses‚ nor leave Gauteng without consulting the investigating officer in the case first.

The officer may also not be at the Linden police station unless he is accompanied by the investigating officer.

The case was postponed to next week.
