Sentence delay for HIV+ teacher who raped boy

The sentencing of the HIV-positive Soweto primary school teacher who raped one of his pupils was put on hold for almost a month on Wednesday.

The teacher‚ who is in his 40s‚ was convicted in the Protea Magistrate’s Court in April of raping the boy‚ then aged 10‚ on school premises in November 2013.

He was acquitted on a charge of raping a second boy‚ then nine years old‚ at Maponya Mall. The boy claimed that the man offered him a lift home from soccer practice but raped him in a bathroom at the mall.

Sentencing proceedings were expected to start on Wednesday but magistrate Audrey Mpofu was not available to preside over the matter.

The teacher‚ who cannot be identified in order to protect the identities of the minor complainants‚ previously told the court that he has known that he is HIV-positive for the past eight years.

The prescribed minimum sentence for child rape in South Africa is life imprisonment.

The case was postponed to July 28.
