Victim tricked 'rapist' to leave evidence

THE Rustenburg mine-worker who was raped by an intruder in the shaft's change-rooms trapped her attacker to leave his fingerprints on her cellphone.

Buyisile Mbobo, 28, who is accused of raping a 31-year-old Anglo American Platinum employee, allegedly dialled his cell number on his victim's cellphone after raping her at the company's Thembelani mine on March 8.

This came out in the victim's statement which was read out at the Rustenburg Magistrate's Court where Mbobo was applying for bail.

In the statement read by prosecutor Orlinah Mputla to magistrate Amanda Roos, the victim said she found Mbobo hiding in the shower in the female change-rooms around 4am as she was getting ready to start her overtime shift.

The intruder told the woman that he was lost but then allegedly drew out a screwdriver, instructing her to undress.

"He asked me to lie on the bench but he could not fit and then he ordered me to lie on the floor. I told him I was menstruating. He said he didn't care. He penetrated me without a condom," she said in the statement.

"Afterwards I tried to trap him to get his fingerprints by giving him my cellphone so he could dial his [contact] number. He did and when I called his number in front of him it went into voicemail.

"He told me that the number was for his other phone that he had left at home," read the statement.

As the man was about to leave, the victim asked him to wait for her so they could walk out together. As they walked out she signalled to one of her female colleagues who was walking past that she had been raped.

Mbobo allegedly tried to attack the second woman but she screamed and ran away. He was later apprehended by security inside the company's premises.

Yesterday, the defence and the prosecution concluded their arguments for Mbobo's bail application. Roos is expected to present her final judgment next week.
