A man's belief that a woman he allegedly sexually assaulted would willingly meet him again led to his arrest, the Pietermaritzburg High Court heard on Friday.

Warrant Officer Sarendra Kisdiha, from Stanger, testified that the victim, who was allegedly hijacked, kidnapped, robbed and sexually assaulted by Xolani Shozi, 20, worked with him to arrange a meeting with Shozi.

During the meeting, Kisdiha kept watch from a distance. He said he planned to arrest Shozi if he was "stupid enough" to think the woman would meet him at her place of work.

About an hour after the agreed "assignation" Kisdiha saw Shozi arrive in the back seat of a car.

He saw Shozi open the back door of the vehicle and wave to the woman to join him, but she refused.

Kisdiha tried calling for back-up but failed. He then drove into the back of the vehicle, which had two other people inside, and pointed a gun at the driver.

He said he saw the driver bend down, pick up a pistol from the car floor, and throw it backwards to Shozi, telling him to shoot.

Shozi did not shoot, but tried to run away. All three were arrested, with the help of security guards.

Kisdiha later found that the other two people arrested, Nhlanhla Mkhize, 23, and Nkosinathi Mkhize, 22, were policemen, and that the gun was a standard issue police firearm with an erased serial number.
