Court bans Dubul' iBhunu lyrics

THE Supreme Court of Appeal ruled against the singing of the liberation struggle song Dubul' iBhunu in affirmation of the agreement reached between the ANC, AfriForum and the agricultural organisation Tau SA.
"The parties have agreed to a full and final settlement of their dispute," Judge President Lex Mpati said yesterday. "They have agreed that it is crucial to mutually recognise and respect the right of all communities to celebrate and protect their cultural heritage and freedom."
AfriForum had laid charges of hate speech against expelled ANC Youth League president Julius Malema two years ago for singing the song. The Equality Court - sitting at the Johannesburg High Court- later ruled against the singing of the song and found that the lyrics constituted hate speech and "may be experienced as hurtful by members of minority communities ."
