Our labour laws are so flawed that I won’t be surprised if the dismissal is deemed procedurally unfair by the labour court. I have just had to pay a guy15k for having dismissed him unfairly although he had admitted to having come to work under the influence of a substance (dagga). Just because I didn’t follow the right procedure now I have to pay him. However he has since found another job in the Middle East so I don’t have to reinstate him. I cannot work with people who are under the influence of dagga.

Our labour laws are so flawed that I won’t be surprised if the dismissal is deemed procedurally unfair by the labour court. I have just had to pay a guy15k for having dismissed him unfairly although he had admitted to having come to work under the influence of a substance (dagga). Just because I didn’t follow the right procedure now I have to pay him. However he has since found another job in the Middle East so I don’t have to reinstate him. I cannot work with people who are under the influence of dagga.Any thoughts on this?
