Teen rapist's life sentence overturned

A man who raped a 15-year-old girl did not deserve a life sentence because she probably allowed the sex in anticipation of "gifts", the Supreme Court of Appeal has ruled.

well even the 8 years he has spent in jail already is too much. kids of today start having sex earlier than that and believe me not with their peers, who's fault is that? as long as the sex is consentual the age is not relevant.
@ Tobby we have 30 year olds who are not clever enough to think for themselves as well should ppl be arrested for boning them as well?

Young girls are easily seduced by bling and perceived power, and with respect, an adult man should be able to control himself. while rape is a crime that should not be justified at all, i am looking at this verdict differently. we are a nation with a lot of school girls who will do anything for money, material things to such an extent that sleeping with an older man to them is fine as long as they get money, gifts and a good life in return. is this not a case whereby these minors are being taught that you cannot( just because the guy did not give gifts and all in that one session) lay a "rape charge". it is a fact that some girls get into these relationships with older men knowing its wrong.

i know of a girl (where i used to stay) who had an affair with a married guy from the same street and was just very happy to be getting money and whenever we tried talking to her (she was about 16), all we would get was that its not our business what she does.

My comment is about ra.pe in general (not this story in particular)

I am appalled (sp) that the learned ones are passing judgment based on one's reaction.......... people react differently to different situations. Most ra.pe victims will tell you that they froze (could neither move nor scream..)

How sure are they about the psychocological or physical scars........ if that is the case I dont think medicine would have "Post Traumatic Disorder/Stress" in their books.................

just out of curiosity, if it is known that they had sex before and gave her gifts, why is he only charged for one rape instead of the previous one as well.? only when he refused to pay up did it become a crime or was the girl older before? so she did not resist, she did not cry and the only thing that constitutes this to be rape is her age.

This story is misleading as there is a lot which is not revealed. Why did the judges reduce the sentence, did the rapist appeal and if so what was the argument presented? To rule on basis that she probably expected gifts in exchange for s@x, I just dont think that was the only reason. Our judges know very well that we have a high rape rate and therefore would not take this lightly.

Of course not, mose. You really need to learn the basics of common logic. But murder is murder, just as rape is rape. Multiple counts should only harden the sentence. Nevertheless an acceptable minimum should be imposed for one count. So in determining GUILT, the number of counts is irrelevant. Obviously. My answer was based on your question "what is statutory rape"........... mental capacity not necessarily level of maturity/reasoning capacity (mental retardation). Here the Children's Act is used.


When it comes to r.ape involving adule mentally challenged people, that is where the Mental Health Act will give guidance with regards to litigating and or sentencing.

I'm not suprised soon there won't be any statutory rape in South Africa. The gorvenment said it's okay for 12 year old to be engaged in sexual intercourse so I guess they will legalise it that a 12 year old can give her/his consent to be involved in sexual intercourse. We need to be careful when dealing with cases like these. In this case we dont have all the facts. Like the Vilakazi case, this girl could have lied about her age and other things but unfortunately unlike Vilakazi the poor guy maybe just could not afford a good lawyer hence he found himself in jail. It could be that the judges realized the mistake which was made and are just being technical with this guy to avoid a claim by this guy against the state. There is something fishy here in this story, it just does not add up and its just unfortunate that sowetan has decided to publish half the story. As a nation, we are all gatvol about the rape stats and feel harsher sentences should be imposed. Judges would not just lessen a sentence unjustifiable.

..... no that is theft. If you go to a prostiitute and you don't pay her afterwards then you have stolen from her. If you seduce a child who is physically incapable of making the decision to have sex then it is statutory rape. If you give anyone a present and then demand sex for the rest of eternity, that is called blackmail / coersion. If you have sex with someone who is willing and the next time you want sex, they say 'no' but you force yourself onto them, that is called rape

themadam: Yip. And like the good little stooges we so often are, we do just that.... never mind the actual facts. But what choice does one have. One needs to be able to rely on the media in order to be informed. I read a few papers, but only use this one for online comment. The discrepancies between papers can be very amusing. On one occasion, simply by omitting the word "not" The Sowetan reported the exact opposite of what had happened and only corrected it after several letters to their editor.

This is bull, period. It is a fallacy that the women and men on our benches are beyond reproach or shall we say they were under the influence and highly intoxicated with legalising of illegality. For starters, the girl was 15 and surely the man overpowered her in terms of her young mind.

Making this absurb judgement in a country where r@pe is a scourge is tantamount to giving a licence to those scumbags as long as lawyers will argue the technicalities off such attrocities and those idiots at the Supreme Court, will rubber stamp such nonsense. I still say, the playing fields are not level.

How can in the first place reduce statutory r@pe into a business transaction, baffles me. I am loss for words.

Now can somebody please explain this to me: Does (b) above mean that the 12 year old has been raped? and if so, shouldn't a case of statutoty rape be opened the minute the brat asks for abortion?

You may be right or may be wrong. That is why the judges had given that slight hint of BENEFIT OF THE DOUBT. These children of today reach the maturity stage arround the age of 15/16 years. Example: you ask her the age, she tells you she is 18years old and persist on that. You propose, eventually you sleep with her. Then what?. You'll end up behind the bars should you get caught. It is your word against hers backed by the state. Afterall you did not ask for her ID. Why would you.
