National Director of Public Prosecutions Menzi Simelane's appointment was unconstitutional, the Constitutional Court ruled.

Judge Zak Yacoob said President Jacob Zuma's appointment of Simelane was invalid.
"The requirement that the NDPP must be a fit and proper person for appointment with due regard to his conscientiousness and integrity was not a matter to be determined according to the objective opinion of the president," he said handing down judgement.
The court was ruling on an application by the Democratic Alliance to confirm a Supreme Court of Appeal ruling that Simelane's appointment was invalid.

Thank heavens. With this precedent from our highest court, maybe civil society can start making sure that the government is run efficenlty, by " fit and proper " people. Can the appointment of the president not maybe be challenged ?Report Abuse

i think the president must appoint whoever was representing him during the rape charge to be his advisor. that is the is the only case that he won in the court of law he has since been on the wrong end of all the decisions taken since then.Report Abuse
