Malema associates get bail

Four business associates of axed ANC Youth League leader Julius Malema were granted bail of R40,000 each by the Polokwane Magistrate's Court today 25.09.2012.

 No evidence that they were a flight risk 

Kagisho Dichabe, Lesiba Gwangwa, Helen Moreroa and Selby Manthata all made an appearance in court.

Four companies were listed on the charge sheet: Segwalo Consulting, On-Point Engineers, Gwama Consulting, and Oceanside Trading.

Prosecutor Billy Moalusi did not oppose bail.

He said the four had co-operated with authorities and there was no evidence that they were a flight risk.

Magistrate Janine Ungerer ordered that their passports be handed over.

Counsel for each of the accused read out their affidavits.

All four proclaimed their innocence on charges including fraud, corruption and money laundering.

In his affidavit, Dichabe stated he had four minor children and asked to be released on bail.

He said he was able to pay R40,000 bail.

He said he was innocent of fraud charges against him, adding he was not prone to violence or dangerous.

The State alleges the four misrepresented themselves to the Limpopo department of roads and transport, and a R52 million contract was awarded to one of the accused.

The court heard that the fraud charges also related to designs owned by the department.

They would return to court on November 30, Hawks spokesman McIntosh Polela said.

According to a City Press report, Public Protector Thuli Madonsela said Malema had made millions from the R52 million tender by On-Point.

Although Madonsela could not find any evidence that Malema interfered in the tender process, she found that he benefited "improperly" from the contract.

Her investigation found that On-Point acted corruptly by signing back-to-back agreements with subcontractors, the newspaper reported.

Madonsela recommended that the tender be immediately cancelled, that the National Prosecuting Authority and the Asset Forfeiture Unit consider criminal action, and that the Master of the High Court investigate the flow of money into Malema's trust.

Malema, whose Ratanang Family Trust was one of two shareholders in On-Point, would appear in the Polokwane District Court at 8.30am on Wednesday.

Malema faces a charge of fraud and money-laundering relating to the On-Point tender.

The four accused handed themselves over to the police on Tuesday morning before their court appearance.

Several police officers were stationed inside the court on Tuesday.

Courtroom J was packed to capacity with reporters, photographers and the public.

Outside the court, the police cordoned off streets around the courthouse. Police nyalas and vans were parked across streets.

Brigadier Hangwani Mulaudzi said the police had put their security plan into action a day before Malema was scheduled to appear.

Police wanted to be prepared for a planned night vigil for Malema, and to ensure people were safe, he said.

Mcm... wats R40K to these people? this just shows the seriousness of this case cause these people looted Millions so their bail should have been millions as well. We will never see the end result of this court as it will drag drag n drag until it disappears.

There has never been honour amongst thieves. The entire country needs to be placed in administration (independent foreign auditors) to sort out the mess that is our economy, and retrieve all the stolen money

This entire thing is going to backfire as it is completely based on hypocrisy and double standards. Let's face the truth: tenders at national, provincial and local government levels are riddled with things like this. Municipalities around the country are dismally failing to deliver because of irregularities in tenders. Now for Jacob Zuma's supporters to think that they can go after these young people when there are many others in the Zuma camp who are dealing with billions of Rands and not the peanuts these young people are being charged, is just plain hypocrisy. These charges are only meant to slow these guys so that they are starved of resources to support an alternative candidate. On the other hand, Zuma supporters have access to state resources and even use both ANC and government resources to advance his campaign for a second term he does not deserve at all. It is time for this hypocrisy to be exposed once and for all. The ANC and the country do not need this kind of thing which is not aimed at routing out corruption but propping up a useless and hopeless candidate who is fast losing favour with ANC members and the rest of South Africa.

Run stupid fat-boy run. Now we know why you're so fat. When you steal from the poor you must suffer and rot in jail. We can't support people who steal from our taxes which are meant to help the poor. I remember when Malema insulted Helen Zille by calling her a racist white girl. Helen Zille is the most humane, principled, honest and humble politician in South Africa. She has always fought against oppression of blacks and white alike. For stupid people like Malema to insult great leaders like Zille meant he will never get any respect from me. When Zuma was busted for impregnating Khoza's daughter, Malema came out in defence of Zuma instead of criticising him for his immoral and promiscuous exploits. Malema and Zuma are the same. They have no morals or values. They’re both unprincipled individuals who deserve no respect from South African public. Let the law take its course.

It was the City Press that exposed Malema as a fake "economic freedom fighter" who lived large on kickbacks received from tenders he allegedly help secure for different businessmen/women in Limpopo.
It was Afriforum (not Zuma) who oppened a case of corruption against Julius Malema.
It was the DA that approached the Public Protector to probe tender irregularities in Limpopo that were allegedly linked to Julius Malema.
It was Julius Malema himself who said "they must come and investigate me, my books are open, I do not have a million in my bank account"

The only thing "wrong" the ANC did was not to undermine the rule of law by allowing due process to run its course, yes, for that we can blame the ANC. Why should the ANC uphold the law? Malema has shown time and again that he believes he is bigger than the ANCYL (that is why everyone in the YL is running after him like puppies after their mother), he always behaved as if he is bigger than the ANC itself and of late he thinks he is President of the Republic of South Africa.

Ask youself why he ran to Marikana to dance on the blood of the dead instead of running to Mathale's office to toyi-toyi against service delivery in Lollypop Province.

You might be fooled by Malema, not everyone is!

Malema is really bargaining that the masses are stupid by trying to convince them that the case of corruption is due to his opposition to Zuma.

People who act in a court of law, from the laywers to the judge, are proffesional people with years of studies and experience behind them and who follow due process to get to a verdict - there must be evidence etc, etc. - something that Malema and his 4 friends wouldn't understand as he did not even finish school. He does not even understand what a lifestyle audit is - that's why he got caught.

You must be quite desperate to think the masses will believe such an argument - rather say nothing than look even more stupid.
