The SA Revenue Service (Sars) has obtained a R16 million judgment against former ANC Youth League leader Julius Malema for unpaid taxes, according to a report on Sunday.

@9Naija, Malema's house in Sandton is not 16mil the press was proven to have mislead the public on the actual price Malema sued them and was successfully and the paper which first published the story was ordered to apologise for reporting misleading information on Malame financial affairs. Let's get some facts straight in the process of triumphalism.

Why did SARS let the debt to this high? over what how long period of time interests and penalties accummulated and why didn't they act at the first instance or least 3 months later if he ignored correspendence to him? But they chose to investigate his tax issues only in Sept last, jsut about the time he fell out with the anc president? And as an ordinary citizen I must believe this is not political settling of scores using our national resources?

Malema you upset the powerful in the land, now you are a paying a price, I do hope the group calling itself friends of Malema, will push forward with all the national issues you raised, cause your arrest should not result in the death of struggle for economic emancipation. You should know that, this can only make you stronger, I am not your fan, but I stand for social justice, like everyone of us, you deserve justice, as things stand now they state is after you for calling raising awareness about continued disparities btwn the poor and rich,

My bet is that if Malema goes to prison he will be assassinated inside before he even stands trial, to silence him from revealing who else is corrupt or who in the anc helped him to be this corrupt to the point he is now a multimillionaire, political assassins can nto take him out whilst outside prison, it would be too damning for them.

And SARS will confiscate his houses to pay their R16 million owed. 9 other people will be charged alongside Julius, all for corrupt tenders. Wonder how many of them are in the FOYL.

I am not a supporter of Julius mara I must agree with RoseNtuli - if he was quite sharing out the loot and not talking too much, he would have lived a very peaceful luxurious life, and that is an indictment against the ANC led government. This is not a government fighting corruption (which is really that it isnt) but ANC abusing the power it has through government and the abuse is two fold - one that if a corrupt person is in their good books they are protected, and secondly that the law is only used to settle scores.

Oh Africa...when will you arise from the ashes of corruption and greed?

I think some people have wild ideas. How does silencing of malema has to do with the gwangwa. What they charge them for is criminality. How on earth you think even if kgalema becomes a president he will nationalise the mines. That is impossible. Malema was used to make negative noise about the government of Zuma and when that failed he wanted leadership change. Problem he assessed zuma's leadership alone and concluded he is not good. He was told lot of time, raise the issues through internal processes but didn't take that. He was media drunk, limelight drunk. Then the media exposed his lifestyle and then it is political conspiracy. Nationalisation was and has been discussed in the anc and there is no way it will succeed. Malema represented the interest of few in the issue and those who wants power either dead or alive. Kgalema was to be their stopping stone towards that but Nationalisation is nothing real but just a big fat propaganda that I will laugh at those who support kgalema and it doesn't get implemented. Ofcourse we know that our government is run from the major imperialist economies, do you think kgalema stand a chance to take the route of nationalizing. What will our country be if we nationalise. Zuma was wise if that might be to unmasked those behind the fat boy by dealing with him. All are quiet now. Cause the YL is stupid they will spread propaganda saying the arrest is political and then bus in people all over only for the case to be postpone and they little they have dries up.you can't intimidate the government you so love and voted for especially if there is no alternative opposition with same history as them. Malema thought he is greater than all. If he doesn't find his way he intimidates while forgetting he is there cause he was elected and that power will come down oneday. He is doomed guys, let the law takes its course. Let's go have beer and see the outcomes on Wednesday if they are asked to plead or not and we take it from there. OK, so Malema was awarding himself tenders, he was writing his own cheques for his own trust? Whoever can not see that there is a conspiracy need their heads examined! Malema will have the last laugh! Malema has never been a government official, neither has he ever been employed as a public servant, as far as I know, those are the people who can award tenders not politicians. If anything, he should be charged together with so many others, especially from the government! We are waiting for him to board a plane and come "home"here in Zimbabwe.

I am a law abiding citizen , so i stand by the law to bring down corruption but detest when the law does not takke its course equally. SOME ARE MORE EQUAL THAN OTHERS !!.

The criteria for candidates to contest for presidency of any political party should include academic gualifications being CRITERIA 1.

Politics is just a game one doubts if there is any political party which will serve its people without plutocracy or greed.

There is something sinister about these charges and the timing thereof and this could be a fabrication from the man from Nkandla to pave a way for him for a second term. Malema owes SARS R16 millions, how much many he supposedly made to owe SARS that much? I wonder if even some of the richest people in this country including the Motsepe's have paid that amount to SARS. Apparently the security clusters ministers had an emergency meeting in Cape Town and among other things was to discuss Malema. What worries me is that the current head of NPA was part of that secret meeting, so was the minister of finance Pravin. I thought the NPA is an independent chapter 9 institution that does not need a group of Cabinet ministers to tell them who to charge and when? When Zuma expelled Malema from the ANC he was confident he will silence him and when that has failed the regime is resorting to desperate measures. Can someone tell me why was Malema barred by police from addressing the miners and forced to leave? Personally this are the signs of a dictator and a police state where enemies of the regime are isolated, persecuted, jailed or even killed and we should all be worried about the direction that this country is taking.

You are the only reason I login today. I really don`t know what to call a man like you. You have been hiding your DA alliance for years on this site, why is it so difficult for you to come clean & say people must vote your DA, you are a dog without teeth, you just bark no bite, no offence.

Coming to the JM arrest, I am glad the day has come even though the charges are still not clear as his lawyer stated, he will only be charged when he hands himself over to the authorities.

Personally, I think this is the biggest mistake again by the ANC, same thing that happened to JZ during TM`s reign, this will make JM stronger and more people especially the poor will sympathise with him like they did with JZ. On the other hand let the courts clear him unlike JZ.

JM is very rich & he will make a deal with SARS, SARS is not interested in seeing someone going to jail for not paying tax, Khoza owed SARS R63M, he made a deal & settle with SARS without jail term, I see this boy following the same route.

There is nothing new in what On-Point was doing, gov use agents/outsource certain activities when they don`t have the skill within their ranks. On-Point had a contract with Limp gov to administer their construction tenders. If On-Point fraudulently received kickbacks, let the courts prove it & cancel the contracts.

Some people never learn. This is a politically inspired trial. One that is going to drive the last nail into the coffin of Jacob Zuma's political career. I do not see how he is going to survive this one. Generally, Jacob Zuma is out of favour with young people around the country. He is also out of favour with people in the urban areas and probably also in the rural area, just that their opinion in not generally sought by pollsters. However one looks at it, Jacob Zuma is in serious trouble and not even COSATU and the SACP are going to save him. There is no way that Jacob Zuma with all his failures, pecadilloes and warts is going to be pushed down the throats of young people in this country. Whoever tries it will be destroying the ANC. Not even one of Zuma's most ardent and pasionate supporters can string a coherent and cogent argument as to why Jacob Zuma, incompetent as he is, deserves a second term as president of the ANC and the country. The onky reason why some people would support him is because they think he is their passport to BMWs, houses, tenders, plum positions in government. Otherwise they themselves honestly know that Jacob Zuma has been bad for the ANC and country.

Malema's looming trial only shows that the Hawks are not independent and being hopelessly manipulated by politicians. One will understand why ANC MPS in Parliament who support Jacob Zuma are dragging their feet instead of coming up legislation to make the HAWKS independent, as instructed a long time ago by the Constitutional Court. One thing is clear. The HAWS are the only agency pushing for a trial to settle political scores. They are the ones leaking information to the media, and giving the impression that all the other agencies want Malema tried for fraud and corruption. But it cannot be true. Thuli Madonsela has not released her final report yet, and the best she can do is recommend that Malema repay money, definitely not charges. The same applies to SARS, the best they can do is demand R16m in taxes and definitely not a trial. The truth is that the HAWKS are being manipulated by politicians to settle political scores. They themselves know that they do not have a case against Malema that can stand in a court of law, but are prepared to charge him to please their political masters. The truth is that tender fraud is very rife in this country and there are so many irregularities around the country. To go after Julius Malema instead of fixing the leaks in the entire system is just plain hypocrisy and double standards. This kind of abuse should not be allowed in the post-apartheid South Africa.

@Sinudeity, I feel sorry for you cause you are not able to halt your excitement at perceived 'down fall' of Malema, its actually embarrassing (on your behalf) that in the midst of your excitement and triumphalism, you seem to miss one major fact, that Malema has still to stand trial ONLY upon being proven guilty based on the evidence will he be sentenced, this could be a long drawn out battle, you are already presenting him as convicted, based on what you call evidence which has been in the known? this evidence you talk about, how was it that, before it is tested in the court of law, according to you its in public domain? can you see how whoever is after having Malema arrested and convicted has already stuffed up this case even before it reaches the court for decision? Malema's lawyers if they are worthy of their salt, they should use all that in their stride, that as you allege evidence has been in the public domain that prejudice his case, and how come you already know that Thuli has done her investigations into alleged tender fraud involving Malema when an official disclosure on her findings have not been made publicly or fwd to the authorities tasked with investing fraud? Do you see why many doubt Thulis integrity and believe she reports to the DA?

Anyway I await in anticipation for Malema to appear in court, so we can know what his defense is on all these charges.

Like Progressive Democrat I agree that this is one stuff up which will haunt the anc, cause how in the world did Malema managed to help himself to the public funds to the tune of these millions, when he is not a gov signatory ie authorising awarding of tenders, how the anc is going to explain to tax payers how did they allow tax payers money to end up in Malema's bank account, that is what is interesting for. This is actually a good case this, cause the anc regime needs to explain itself not just Malema.

if i so much as submit my returns late, i get letters, sms and emails as a reminder to this. My tax is a drop in the ocean in comparison to this.
my question is, why is sars very efficient to some tax payers and not all? Would i have been still standing if my returns were in arrears by R10,000?

All those who think and believe that "the ANC only started to act against Malema after he started attacking the ANC and Zuma" are sick, very sick in their heads. It is the other way round you fools. Malema started to attack Zuma and the ANC only after they took him through the first Disciplinary Hearing in 2010, the one in which he pleaded guilty and received a suspended sentence. The two year suspended sentence had not lapsed yet when he committed the same offenses again, hence his second DC appearence and subsequent dismissal.

All of you should recall the 3rd Degree interview in which Malema told Deborah Patta that "I do not listen to those old people", that was after Deborah asked Malema if ever the ANC leadership ever talks to him about his many controversial public pronouncements. Malema admitted that every monday when the ANC National Working Committee meets at Luthuli House, he is asked to explain some of his utterances and also called into order. Zuma has constantly told parliament that the ANC does talk to Malema behind closed doors but not through the media.

The multi-pronged investigations were started when Malema was still a member in good standing, if I recall well, it was the DA that approached the Public Protector to probe allegations of tender irregularities in Limpopo and Afriforum oppened a case of corruption against Malema, not the ANC. I do not see how the ANC influenced Afriforum and the DA to act against Malema, or are we saying both the DA and Afriforum are sub-committees of the ANC?

Malema must explain how tender money ended up in his Ratanang Family Trust and most of it into his belly. Malema will try to make this an ANC issue, the ANC had nothing to do with the investigations. Malema must tell the truth as to who actually asked the HAWKS, the Public Protector and SARS to investigate him. Malema must also remind the public, most of who have a 1megabyte memory that he publicly declared that he had "nothing to hide" and invited the agencies to "come and investigate, but they will find nothing".

To the Zuma lovers, Malema has been like this from day one, why they decide to hate him now, is it because he is telling the truth about Zuma and his followers in parliament?? All said by Malema is 120%, just that he must talk truth about the others and respect others??? that's rubbish. Also the Zulu king is indeed recieving much priority than the others why? If a Company is on Municipality Database; and the Internal Procurement Processes chooses the winning "Bidder". Either as One Point Engineering or anyone Comapny that qualifies. Then how come can someone who won the bid can be found guilty of corrupt activities or of influencing internal bidding and procurement processes while not sitting on a payroll of that Municipality or sitting on a Tender Committee? Were they not supposed to charge the Municipality officials for corrupt activities? For example the former Police Commissioner Mr Bheki Cele was found guilty by the Public Protector for signing a dodgy deal with Business Guru Mr Ruh Shabangu. It was not Mr Shabangu who was found guilty or who was charged. So in this regards why the name of the game changes when its Julius Malema? Hating someone and shifting the blame undermines the Justice System and the Credibility of the Public Protector. The Trust fund in its original form when it gets registered does not specify or put limits who can deposit money and those monies y that are deposited in any trust fund are not taxable. The tax laws stipulates that they will start to be taxable as of 01 April 2012 financial year and beyond. So what are these guys (SARS, Public Protector and Afriforum) talking about here?
Another thing how can Julius Malema owe SARS not One Point Engineering as a Consultation Firm as he is one of the shareholders? Is One Point Engineering a human being or Julius Malema? Why not other shareholders or a company as whole not charged??? This is first class rubbish!!!!!!!!!!!!!!

You cannot charge individulas here wherease there are registered companies who received tenders. SARS does not know what they are doing or talking about! Companies must be charged and shareholders will decide whether they represent their companies in their ' personal capacity' or 'hire lawyers'. After having won the bid or tenders; is out of question if I take some of my dividends as a shareholder and give to my girl friend or even to Sinudeity . 'Freedom of association prevails including in financial iuuses'

I like these blogs, just by looking at someones username u can tell a lot about the comments they will be making, i belive Polokwane matric results over the past 15 yrs should be reviewed, also an inquiry into busaries awarded to polokwane people should be innitiated, it looks like corruption started way back in that province. there seem to be more pigs in a sack thatn there is true professionals coming up north, like lenyora buckselona said, too much "come to jozi" fools from this bunch

Nice speach there but the same cannot be said about its ending, this here is not about the two men but us the citizensm and our legal system, when people start perceiving the legal system as lacking in intergrity we have a seriouse problem, this two can fight their battles later i dont really care, this here is about us and our systems, the sonner we r shown that the legal system is still intact the sooner we can deal with corruption. as it stands now, u whistle blow and corruptions gobles u up, and no one goes to jail for it.
