If it happened during office hours then as a practicing doctor the court must consult his Ethics Policy in terms to dos' and donts' and a business conduct at large. I do not discount that the doctor may be lying, and he may have breached a code of conduct. I do not however rule out the possibility that the doctor is being truthful and is non violent person! So far anything is possible.

Guys, why playing ignorency of the obvious things. This is very clear for everyone in this case but people would forever hide behind their thumbs. According to a statutory law that governs our country, there is absolutely no case in this matter, why because two adult of consenting age agreed on common action. Act done and dusted. No rape factor, case closed.
Option no.2. Conditional manipulations: because the act took place at the working environment and involved the proffessional personel , even if two people involved in act had agreed on it and it has been going on for more than thirthy six months, the other part feels, she has to use the proffessional situation for her own selfish benefit, to compensate her unfavourable social circumstance capitalising upon the environment to which the act happened , which would unfairly benefit her , as proffessional ethics would blindly punish the proffessional, despite time factor, age conviniency ,consent and personel privacy consideration.
There also gender factor, here that is being ignored or unfairly treated. If the Doctor was a female , most of factors would have been ignored in her favour.
The outstanding question is, are the patients at liberty to approach health staff for such manipulation and freely, put them to such vulnerable sexual simulations situations and get away with it simple because they are wearing the patients blanket even if , nothing has proven them to be patients,wasting the public resources for their selfish interests?
Lastly why should the proffesionall code of conduct, outshine the statutory law in terms of decision making? We need future reviews arounds this, as we cannot sitback and look at our human rights being abused on silly conditional bases, converted to punishing sublaws.

The Doctor in this case is also a physical human being , not spiritual , liable to get physical urge like every physical being when deliberately tempted to such, proffession doesnt have that power to turn him to spiritual statue, when provoked. But that doesnt have anything to do with his skills delivery for right cause when asked and expected to do so, inan objective and proffessional manner. But theory makers would dwell on theories, forgetting that we are not only the theory statues, there is that physique in us, which constitute 99% of our being.
