The story does not tell us how big the truck was. 44 passengers sounds more like an over load and if it was, then braking was not easy.
Also, the rail crossing bell and lights, no one has mentioned whether these were in working order. If they were, then this man is guilty of killing all those people.
The truck stalled when he was crossing the railway line , the truck had a mechanical faulty , where is the truck owner who knew that his truck is faulty and just because he is a racist still let innocent people use the truck , to me he is the most guilty one who must be charge , I know Mandlazi was on the driving seat of the truck , but if the truck did not have a mechanical faulty it should have crossed that rail line without any problem.

OK, I hear you, but, irrespective of all those factors, the driver is liable for his actions. If there was loud music or the truck overloaded or passengers were singing, he was supposed to stop them.

Mpumalanga...I think there is real cause for all the accidents in that province; ILLEGAL license holders. A while back in the late 90's and later, a lot of people flocked to get their licenses there. Maybe in Maputo, trains wait for trucks at level crosing or there are no level crossings at all. The Authorities should never allow anyone from outside South Africa to drive withought permit from SA. His boss must be investigated as well, how did they allow him to transport so manty people in a truck. It is not for the first time this sort of a thing happen in Mpumalanga, some few years ago it happened and the driver was foreingh as well, why can't we learn from our mistakes. Report Abuse

If the breaks failed, and the bell and lights at the rail crossing were working, then surely the driver would have managed to change down breaks and reduce speed. now what are the chances that, the breaks were not working, the rail lights and bell were not working either and then a possible overload?
The driver survived, so that means the trailer is what was hit and that can only mean trying to beat the odds.

I dont think it is more on the country of origin, but an accident is inevitable you will not predict when it will happen. What i rather find disturbing is the fact that within a week he is about to be sentenced, the guy from the Cape who commited exactly the same offence or even more was sentenced after 2 years, Jub Jub did exactly the same and killed 4 people but he is still celebrating mandela day in Kliptown with free champagne. Yes it is sad to loose a loved one and sometimes passing the blame helps to ease the pain but in this case its sad cause this guy was the driver of that truck on the day. No. it is not right but chances are that he might skip the country if given bail as he can not live in the same area that he was living in prior to the accident. Much as I want Jub Jub to pa for what he did, he is well known and can be recognised should he want to skip the country.

The fact that we don't know how big the truck was and what are the circumstances surrounding the incedent. This makes his innocent until proven guilty by the court of law.
Probable there was a mechanical failure on his car or the barriers at the crossing were not working or the traffic lighis at the rail crossing were not working.

The driver is guilty of failing to stop at a level crossing, hence the large number of the dead. The govt should legislate against people transported in vehicles suitable for 'goods only'. a truck is not suitable to transport human cargo. In other countries no-one is allowed to use 'heavy goods vehicles' to ferry people, due to health and safety issues and that they not designed for that purpose. SA is not Mali or Angola where vehicles to move people are in short supply. OK, I hear you, but, irrespective of all those factors, the driver is liable for his actions. If there was loud music or the truck overloaded or passengers were singing, he was supposed to stop them.
Youe see, we cannot justify and accept the driver`s behaviour. He is, by law, supposed to know the rules of the road.

Possible hey and knowing men and the funny stunts they like pulling while driving, I can hear some coaching him to beat the train well sad he gonna pay the price alone, I still feel him pleading guilty will be better atleast community and the families of the deceased will feel like he's taking some responsibility.

You cannot stop jubilation of others,I used taxis when I was a student for Mabopane and Soshanguve before i moved to Mamelodi, those taxi play full blast music you can not interfere with driver till i decide to have my own,but if the accident happen the driver is liable

Mpumalanga...I think there is real cause for all the accidents in that province; ILLEGAL license holders. A while back in the late 90's and later, a lot of people flocked to get their licenses there. Wheever there is a level crossing, u dont just cross.. Its even worse if one uses the transport that is likely not road worthy and r carrying people. and the dude is going to anyway, either he commits suicide or the community kills him so nje i bail is out of question.Im sure it wasn't intentional.. Maybe in Maputo, trains wait for trucks at level crosing or there are no level crossings at all. The Authorities should never allow anyone from outside South Africa to drive withought permit from SA. His boss must be investigated as well, how did they allow him to transport so manty people in a truck. It is not for the first time this sort of a thing happen in Mpumalanga, some few years ago it happened and the driver was foreingh as well, why can't we learn from our mistakes.Report Abuse

If the breaks failed, and the bell and lights at the rail crossing were working, then surely the driver would have managed to change down breaks and reduce speed. now what are the chances that, the breaks were not working, the rail lights and bell were not working either and then a possible overload?
The driver survived, so that means the trailer is what was hit and that can only mean trying to beat the odds.

I dont think it is more on the country of origin, but an accident is inevitable you will not predict when it will happen. What i rather find disturbing is the fact that within a week he is about to be sentenced, the guy from the Cape who commited exactly the same offence or even more was sentenced after 2 years, Jub Jub did exactly the same and killed 4 people but he is still celebrating mandela day in Kliptown with free champagne. Where is the consistancy in our justice system, having said that such incidence we cannot prevent due to the incosistency!

@Memme, I agree with what you saying. It wasnt his intention to cause the accident but it happened. Yes it is sad to loose a loved one and sometimes passing the blame helps to ease the pain but in this case its sad cause this guy was the driver of that truck on the day. And i dont think blaming him will bring any of the lost souls, so the family should just focus on grieving for thier loved and eventually time will ease the pain.Report Abuse

No. it is not right but chances are that he might skip the country if given bail as he can not live in the same area that he was living in prior to the accident. Much as I want Jub Jub to pa for what he did, he is well known and can be recognised should he want to skip the country.
No one must be above the law irrespective of what role you play in society.

The fact that we don't know how big the truck was and what are the circumstances surrounding the incedent. This makes his innocent until proven guilty by the court of law.Probable there was a mechanical failure on his car or the barriers at the crossing were not working or the traffic lighis at the rail crossing were not working.
Lets wait for the court proceedings before we give our vendict.

The driver is guilty of failing to stop at a level crossing, hence the large number of the dead. The govt should legislate against people transported in vehicles suitable for 'goods only'. a truck is not suitable to transport human cargo. In other countries no-one is allowed to use 'heavy goods vehicles' to ferry people, due to health and safety issues and that they not designed for that purpose. SA is not Mali or Angola where vehicles to move people are in short supply. The govt should be held responsible for not safeguarding the lives of its own subjects, treating them like cattle all the timeReport Abuse
