Khoza identified in police line-up

MURDER accused Mody Khoza was positively identified in a line-up at Hazyview police station in Mpumalanga last year.

Khoza, according to witnesses, was identified as the person who was helped to push the car that is linked to a murder.

This is according to Captain Hanyani Joseph Moshoane, who gave evidence in the murder trial of Johan Ndlovu.

Ndlovu was the ANC chief whip in the Ehlanzeni district municipality.

Moshoane told the Nelspruit Circuit High Court yesterday that the parade was held on January 24 last year.

"The parade room was a one-way glass. There were two witnesses and a photographer." Moshoane said. The first witness, a man, pointed at two people. One of these people was Mody Khoza."

He said he had had no information about the case prior to the identity parade.

Khoza's attorney, Katlego Matshego, asked why the parade was held without the suspects having legal representation .

The other accused in the case - Bongani Mkansi, 28, and Life Khoza, 24 - were also present at the identity parade. Velaphi John Ndlovu also stands accused of the murder.

Moshoane said the four had told him they had informed their lawyers about the parade and that their lawyers would be present.

"They said we could continue with the parade though their legal representatives were not present," Moshoane said.

Matshego argued: "According to my client they informed you that they were expecting a lawyer from legal aid to be present at the parade. That is between you and your client. I do not know anything about that," the police officer said, causing the people in the gallery to laugh. - mashabas@sowetan.co.za
