I think this story goes deep...most families especially African ones have deep seated pain,bitterness and unforgiveness which is trans-generational.So I think if you track the genesis of the story it dates back decades ago.

The story highlights a tendency of children staying in a family home for eternity, surely they should be independent by now instead of waiting for the parents to di.e and then start fig.hting over the house. A few things don’t make sense though, for the father to transfer the house to his name he would have needed a Letter of Execution which is a requirement by law in a decea.sed estate unless there was a will which I doubt. He would have needed a lawyer to do this and only then could he transfer the property to his name. Then he would need to have following the conveyancing process to make the transfer effective, at the end of the day it is the title deeds that prove ownership.
If indeed the father had followed this process and is entitled to sell the property and the property had been subsequently transferred to the Kumalos then they are the legal owners of the property and have every right to evict them and lay a charge of trespassing. From a legal perspective it is easy to untangle this mess, a simple deeds search will tell you who has a case and who doesn’t this can be done in seconds. If the father sold property he is not entitled to sell then he must reimburse the buyers or face charges of fraud.
Township properties are a headache as there are always a number of parties who have a vested interest.

Its never that simple, there is a process to be followed to get title deeds which I doubt was followed just reading what has been said, title deeds are not transferred automatically. You're right. It is so sad that in our community we tend not to allow our kids to leave the nest as soon as they can. Sometimes it's the parents who hang on to the kids and sometimes the kids themselves hang-on for dear life. This happens everyday, this story is exactly the same story that happened in my location. An old man going for the bhobhodlwane!!! The man sold his house and stayed with this lady at her RDP house. She enjoyed the thousands and when they were finished, she chased him away. The Mkhulu is now homeless and staying in the streets!!
Family homes have always come in handy, providing shelter for the less fortunate family members. The challenge is when they start fighting among themselves, which is bound to happen once the old man passes. He could simply be avoiding future squabbles while cashing in at the same time. Report Abuse

This is why as Africans we will remain poor, this house was passed on to the Father by the grand father meaning the father also inherited this house from his father, he was supposed to pass it on to the next generation insuring his family is not homeless same as his grand father did to him, this is how you pass on inheritance from one generation to another, now the fool has sold the house what happens if this woman he is married to divorces him, if something happens to the woman who is going to take care of this old man, does he think after this this two women would still respect him as their father. When my father left the township back in the 90s he left the old house in the township to me and my brother which we were in high school back then, my brother and I have now left the house to our cousins who moved from Fre.e State to finish their schooling hear, the house still remains in the family and we are guaranteed that we still have a family house if any hard shift was arise. Look at what white people do they pass on their first cars to their children so that by the time they go to tertiary they already have cars and what do we black people do we sell our first cars and pass on nothing to our children... You're right. It is so sad that in our community we tend not to allow our kids to leave the nest as soon as they can. Sometimes it's the parents who hang on to the kids and sometimes the kids themselves hang-on for dear life. We need to catch on to the times, we need to encourage adult children who are self dependent, especially our women cause they tend to use the physical assets to survive.

This happens everyday, this story is exactly the same story that happened in my location. An old man going for the bhobhodlwane!!! The man sold his house and stayed with this lady at her RDP house. She enjoyed the thousands and when they were finished, she chased him away. The Mkhulu is now homeless and staying in the streets!!Report Abuse

This is why as Africans we will remain poor, this house was passed on to the Father by the grand father meaning the father also inherited this house from his father, he was supposed to pass it on to the next generation insuring his family is not homeless same as his grand father did to him, this is how you pass on inheritance from one generation to another, now the fool has sold the house what happens if this woman he is married to divorces him, if something happens to the woman who is going to take care of this old man, does he think after this this two women would still respect him as their father. When my father left the township back in the 90s he left the old house in the township to me and my brother which we were in high school back then, my brother and I have now left the house to our cousins who moved from Fre.e State to finish their schooling hear, the house still remains in the family and we are guaranteed that we still have a family house if any hard shift was arise. @Budapatthat is so not true tenants if they are not paying their rent you can apply for an eviction order from the court because that is tantamount to the breach of contract but you can't just chase them away.
