Charges dropped against man found with mentally challenged teen

Charges against a man found with a Soweto teenager, who was the victim of a video-taped gang-rape, have been 'provisionally withdrawn'

The 37-year-old man briefly appeared in the Roodepoort Magistrate’s Court on Friday.

He had been accused of holding the 17-year-old mentally disabled girl against her will at his house in Braamfischerville, Soweto.

“Investigations are still incomplete and we don’t even have a statement from the girl, so we can’t keep him in custody indefinitely,” National Prosecuting Authority spokesman Mthunzi Mhaga explained.

“We want to give the police sufficient time to complete investigations and reinstate the case later.” 

Mhaga said a psychiatric report on the girl, which would determine her mental capacity, was still outstanding.

The girl went missing on March 21 and was found at the man’s house in a search launched after police became aware of the rape video.

Four boys and three men, who matched the descriptions of rapists shown in a cellphone video of the attack, were arrested in Dobsonville, Soweto on April 17. The video was widely circulated on the internet from April 18.

The four minors were granted bail by the Roodepoort Magistrate’s Court on Thursday.

The three men allegedly involved in the rape remain in custody.

This is sad. The law is bringing back offenders into society to see how many other kids will be r aped. It is sad that this gal has been let down by the law once more.

I was wondering why they arrested him, after reading initial reports.....police are lazy . They arrest and investigate later.

This guy was just found with the girl.and even reported it to the police when he saw her picture in one daily paper

Remember the man whom she was found with is actaully the one who reported that she is with the girl after Daily Sun published the photo of the girl. Investigations are vague for the prosecutor to hold the man behind bars but that does not mean he is aquited of any wrong doing. Justice systems sometimes they also protect themselves of any wrong doing by keeping people behind bars without sufficient information. Let the SAPS/CID do their job properly to submit the proof beyond reasonable doubt to the Justice. I am just disgusted at the delay.

Clearly our justice is failing us, How can you expect statement from a mentally ill person. I personally think this M. Mhaga must man up and make decisions like a freal man. Why did they not consult with othet elders and come up with a reasonable decision for this poor girl.

How could they arrest someone with our having any supporting statement...they guy must call me we need to sue them Millions for diformation of chacter, keeping him on cell without any charge against him, trauma, emotionally and mentally shock. etc..
