Mandela served with order to declare his assets

Must disclose how much money he has

MANDLA Mandela has 10 days to declare all his financial interests to the court after the order compelling him to do so was served on his attorneys yesterday.

The court will finally hear whether or not Mandela sold the rights to his grandfather Nelson Mandela's funeral.

If he fails to adhere to the order, an application will be made for the striking-out of his defence. This could mean that a default judgment will be handed down against him.

Mandela has until March 6 to list his assets to be divided equally between himself and his first wife, Tando Mabunu-Mandela. The two are embroiled in a divorce battle.

Mabunu-Mandela's attorney, Wesley Hayes, has requested Mandela to furnish the court with:

  • All invoices, receipts and relevant source of income,
  • Tax returns to Sars between 2004 and 2011,
  • Proof of professional membership or patronage with clubs, societies or associations,
  • Proof of directorship with private or public companies or a close corporation,
  • Disclosure of business and professional interests in the parliamentary register,
  • Copies of bank statements and insurance policies,
  • Confirmation of all positions held as a trustee,
  • A list of assets and liabilities between 2004 and 2011,
  • Copies of any written agreement entered into by the defendant with either the BBC, SABC or any other broadcasting company selling the rights to Nelson Mandela's funeral,
  • Copies of all employment contracts entered into between 2004 and 2011, and
  • Copies of investments, provident or pension funds.

Hayes said the documents were necessary to reasonably assess the size or value of the joint estate. The couple were married in community of property in 2004. His wife filed for divorce five years later.

The order compelling Mandela to declare his assets was made in the Mthatha High Court on Thursday, however, it was only served on his attorneys yesterday.

Representing Mandela, Abrahams &, Gross Inc Attorneys in Mthatha confirmed that they had received a copy of the order.
