Land claim drags

THE BaPhalaborwa-ba-ga-Selwane community in Limpopo is up in arms because the Limpopo land claims commission has not yet submitted relevant information to the Land Claims Court to motion their legal battle against the Majeje tribal authority.

The commission was first ordered in 2008 at a pre-trial hearing in the Land Claims Court in Randburg to submit information, which would help to resolve the land dispute between the Selwane community and the Majeje tribal authority.

The community is claiming land covering several farms and a game reserve. But the Majeje tribal authority is opposing the community's claim, saying the land was given to the Majeje in 1930.

Commission spokesman Motlatsi Lebea said he could not provide details of the matter because court officials were on leave.

The case is very similar to the Bakgatla ba Lesetlheng of Bakgatla ba Kgafela; the tribal authority claims ownership of all land in the Bakgatla areas, this is not the truth because several community members in past would make use of the services of the Kgosi or the Missionaries to purchase land since laws od Paul Kruger never allowed commoners to buy land directly. In case of Bakgatla the tribal authority and the traditional Chief continue to conclude transaction without consultation and involvementof the rightful owners of the land.
