Serial rapist to be sentenced

He is expected to be sentenced today.
Mogale sat motionless in the Johannesburg high court as Judge Frans Kgomo delivered his judgment. This time Mogale's ever-present sister Rebecca was not in court.
Judge Kgomo called the credibility of Mogale's testimony into question, chastising him for frequently changing his version of events.
Kgomo said: "It is my considered view that the accused was not a good witness. He came up with new versions that often contradicted his previous testimony. He is the author of all the contradictions before this court.
"He was an untruthful and unreliable witness, whose testimony cannot be relied upon. His testimony is thus rejected."
Kgomo said following this, "I came to the distinct conclusion that he was not being honest with this court".
Mogale's defence was sunk by DNA evidence directly linking him to four victims. One of the victims, alleged prostitute Nothembela Ndabisa, was picked up by Mogale at a garage in Zuurbekom, along the N12 to Potchefstroom.
Although Mogale denied making use of the woman's services as well as knowledge of the garage, cellphone evidence proved that he had made a call in the area.
DNA taken from inside the condom that was found near Ndabisa's body matched DNA taken from Mogale's blood sample.
Mogale's DNA was also matched in the case of Agnes Wakaba, whose uncle testified that he saw Mogale leave her home in December 2008.
In cases where direct evidence could not be obtained, Kgomo said linkage analysis compiled by the commander of the police's investigative psychology unit, Professor Gerard Labuschagne, was enough to link Mogale to the crimes.
Kgomo found this analysis, which linked a single offender to 11 murders while also possibly linking the offender to another five cases, "quite compelling".
Mogale was arrested on March 27 2009 after Mary Sepeng, who would later turn state witness, reported one of the victims as missing when she failed to arrive home on March 13.
Kgomo said Sepeng's actions were instrumental in stopping Mogale's killing spree. "(Sepeng's actions) precipitated a chain of events that led to the accused's arrest."
Mogale cut a lonely figure despite the judge finding him not guilty on nine counts of kidnapping.
As he was led down to the court cells he said: "In life you face challenges and this is just one of them. I did not commit the crimes they say I committed. Even now, I still maintain my innocence".
Jack Mogale was found guilty of:
- 16 murders;
- 19 rapes;
- 9 kidnappings;
- 2 thefts;
- 2 robberies with aggravating circumstances;
- Escaping from lawful custody;
- Assault with intent to do grievous bodily harm;
- Sexual assault; and
- Attempted murder.
