Concourt set to rule on Scorpions

THE Constitutional Court is to rule on whether the Scorpions should be reinstated.

A Johannesburg businessman, Hugh Glenister, brought an application demanding that two acts, one that authorised the disbandment of the Scorpions and another that saw the organisation being incorporated into the SAPS, be declared unconstitutional and invalid.

"We are challenging the two Acts to indicate that we do not agree with them and that they go against the Constitution. The court should consider all facts in arguments and use its own discretion to make a ruling," he told Sowetan yesterday.

Both the National Prosecuting Authority Amendment Act 56 and the South African Police Service Amendment Act 57 came into effect in 2008. This was after a decision to disband the Scorpions was taken at the 2007 ANC conference in Polokwane.

Glenister first lodged the application with the Cape high court, which dismissed it in February. He now seeks leave to appeal against the high court's decision.

In his heads of arguments, he says it is irrational to disband the most successful crime-fighting unit the country has.

"The rationale of its disbandment is admittedly to get the Scorpions off the backs of crooked politicians and their cronies. This is not a legitimate government purpose," he argues.

The case will be heard on September 2.

No Glenister, disbanding the Scorpions was not at all "irrational". They prevented the ruling corrupt fat cats from further looting. Comrade Selebi can confirm this. With the Scorpions out of the way, the looting could continue unabated... as we can clearly see.

The Zuma led administration will use all available resources to prevent the reinstatement of the Scorpions for obvious reasons. That unit was successful and the rationale behind its disbandment lacked substance,hence the absence of any tangible evidence to corroborate their stupid assertions about the scorpions. What happened to the arms deal case?? BEE deals that means Mandelas' and Zuma's sons and relatives??? Only the scorpions can put an end to my beloved country's miseries...Almost everybody in the higher echelons of our government is illiterate and we expect them to be strategic and competent in executing their entrusted duties?????????
