NEDBANK is investigating a complaint by a pensioner who is under threat of having his house sold by the bank after his title deed was allegedly stolen to secure a loan.

1.But how can the bank use collateral against a propperty that is not owned by the applicant?
2.The bank is in possession of a suspected stolen document.

Word of advise to Madlala

Open the case against the bank for theft as they possess your document, and they will have to prove that you gave it to them and since you didn't. . . . .

they are obliged to give it to you and find the person whom they have recklessly landed money to.

True dat Mnikazi... 1stly his signature is not on the documents and legally they cannot evict him...how ignorant are they to grant a loan to someone using someon's ID book...Hai they were negligent now they must leave Mkhulu alone and deal with Stoan or the son.....

if I was this madala's son or grand son, I would be rich, the bank was going to pay for the emotional distress they caused to this old man, n if he dies in a month or two or three yrs, I would blame it on the bank, how can they not allow my wife to get car finance using my payslip and bank statements, yet they used this old man's house as a collateral?

As far as I am aware you can only use title deeds as security if you are the legal holder of the deeds i.e. the house is in your name. If Nedbank accepted title deeds from a third party without verifying if indeed the transacting party has the right to the said property then they are in breach of NCA and therefore cannot insisting on repossessing the house.

Nedbank has to try recoup its money from the son, they can't kick out the entire family on account of actions by your son. This conduct is rampant particularly by loan sharks but it is also illegal.

I wonder how it happened.Did the son claim to be the owner of the propery?Do they look the same? Are they more or less the same age?,Or at presenting the documents the son admited the documents are not his.Then considering the above,the madala is not liable for any of this.The bank will have to sort themselves out.its their carelessness

tHEY MUST JUST LEAVE THIS OLD PERSON ALONE AND WRITE OFF THE LOAN....
