'My boy stole title deed'

NEDBANK is investigating a complaint by a pensioner who is under threat of having his house sold by the bank after his title deed was allegedly stolen to secure a loan.

NEDBANK is investigating a complaint by a pensioner who is under threat of having his house sold by the bank after his title deed was allegedly stolen to secure a loan.

The 80-year-old pensioner, Khuzani Mahlangu, of Emndeni location in Soweto, is facing eviction after his adopted son allegedly fraudulently acquired loans using his father's identity document and title deed as security.

The pensioner insists he did not sign any surety documents when the loans were granted.

Mahlangu says he later discovered that the thief was his adopted son, who took a R50,000 loan from a certain Rodney and Isabella Stone and used his title deed as collateral.

His title deed has been used twice to secure loan.

"First it was my son and later the moneylender who took a further loan of R112,582 using it as security," Mahlangu claims.

"The boy's mother was my sister-in-law and raising her son was the best thing to do for her since there was no one else but us. And this is his gratitude," Mahlangu says with tears streaming down his face.

He says about two years ago he was visited by the Stones, who apparently had given his son a loan of R50,000, Mahlangu said.

They told him they were planning to sell his home, but before doing so they invited him to their offices to show him proof they had the right to sell his house.

"It became clear at this point that my son had taken a loan using my ID book and title deed as a security," he says.

At an urgent family meeting his son admitted he had taken Mahlangu's ID and title deed without his permission to get a loan.

"He also confessed to taking a further loan from his employer also using the same title deed for a further loan," the pensioner says.

Mahlangu, says his family later took the Stones to his son's place so they could sort the problem out, but it was too late since the Stones had already defaulted on their own loan repayment and Nedbank had already started with the legal process to attach his house.

Last month he was once again asked to vacate and was given six weeks to do so.

"There was no letter of eviction, and I think I am within my rights to resist eviction," the pensioner says.

Miyelani Shikwambana, a group communications manager at Nedbank, says they are investigating Mahlangu's complaint and will comment once the investigation is finalised.

1.But how can the bank use collateral against a propperty that is not owned by the applicant?
2.The bank is in possession of a suspected stolen document.

Word of advise to Madlala

Open the case against the bank for theft as they possess your document, and they will have to prove that you gave it to them and since you didn't. . . . .

they are obliged to give it to you and find the person whom they have recklessly landed money to.

True dat Mnikazi... 1stly his signature is not on the documents and legally they cannot evict him...how ignorant are they to grant a loan to someone using someon's ID book...Hai they were negligent now they must leave Mkhulu alone and deal with Stoan or the son.....
