Support you 110% - Piracy takes away the bread and butter of artists, and I think that most people is guilty of piracy in some way or another - who havent borrowed a CD and burned a copy? We must remember that this sounds innocent but it really is affecting the livelihood of the musicians - we must stop this!

We need to learn the basics here if we hope to alleviate in our societies any form of abuse. Just because someone has violated your rights, does not mean you should violate theirs. This in our law is prohibited. Our constitution talks about an inherent right to dignity that must be afforded to each citizen of the republic. Therefore as much as we condemn piracy of any kind in the strongest possible terms, we must do the same with Lusanda's abusive behavior.

One thing I've seen about Pirates is they are very pro-active, come to JHB CBD they are all over the place selling fake products, it's sad that our local artist are not as pro-active as Pirates when it comes to selling their own products, Pirates are everywere why can't our artist have such a distribution infrustructure, were their product is sold at the same scale as pirated products, untill our artist establish a business model that will allow for such a width scale distribution it will still be hard for them to compete with Pirates. Pirates are outlaws when metropolice come to remove street hawkers they run as soon as metro leaves they come back they are relentless and never give up thats why Pirates will always be in business and that why I think they are not lazy.

- most artist you will hear them on radios telling people to stop buying pirated CDs, but that does not help as you are telling people to do something, when it you artist who must do something first....

I think the government must do something about this, and the recordig companies must move from discs to digital downloads once or even protect the discs from being writted, the is some soft-ware for this. close those firms manufacturing empty discs or companies which stills stores its data on discs must be registered and supplied with those empty discs only no one must have access to these empty discs.

I HATE PIRACY!!!

BUT,

1. The state is going to ask someone to have a sociological imagination of the desperation of this specific pirate viz socioeconomic background, level of educ, abject poverty-cum-unemployment and give him a fair hearing.

2. It MUST be established if the pirate knew whether what he was wrong, which is probably the case. In the context of the huge anti-piracy fight this is extreme unlawful conduct and undermines anti-piracy work in this country. Punishment as a deterrent to others doing the same find application, and point number 1 above falls off if weak explanations came through!!

3. The Mama's method of dealing with the pirate is basically taking law into her hands. You know the story here i wont repeat it!!

4. The Mama's and all other musicians' plight and the deprivation, viz profit theft by pirates, is very touching. Present a few examples of musicians losing their cars, houses etc through bank reposession. Any magistrate with a heart will be touched by this.

5. Point 2 and 4 above supersede all other arguments just listed. There is more harm from pirates in general than what this Mama has done.

6. The Mama's christian background and the kidnapping, assault, present the Mama as a two-faced figure, controversial person, this being none of anyone's business today. The Mama is a human with feelings. Put this one aside!

7. The Mama should be left alone with a light suspended sentence (only with regards to the kidnapping and assault running concurrently eg 1 year)

8. Lastly Mama I cry with you. I cant wait to see this Pirate behind bars, heavier sentence if he is still fit to work.

Use of emotion and so on here, BEWARE OF something called precedence if someone makes a stupid mistake!! Use your heads!

I know it is wrong to take law into your own hands but when the same policemen who arrested Lusanda do buy these faked CD from the street sellers, then what must the artist do, they are taking food out of their own mouth, INFRONT OF THE ARTIST NOGAL. Let us all be sincere, one time or another, we do buy these CDs and most of us are still having them in our possesion. As for the policemen they see these guys especially in Jo'burg selling these infront of them but they are doing nothing instead they also buy these CDs. Its logic if you found someone driving your car without your permission you will definately act on that. What protection do these artist have if we also do the same as the street CD vendors.

I will agree with you on the Kwaito genre. There's Nkalakatha and the rest of the CD is just bulls#it. Then next year it's Godoba and again the rest is rubbish. But still, we shouldnt buy fake. We must just tell these artists to give us " Value 4 Money" music.

People refused to buy even the fake CD of Jabu Pule because it was pure k@k. That should apply to all the talentless musicians. Surely you cant buy a fake RKelly, Yanni, 2Pac...and here at home , Joyous, Zahara ect. I mean that is..classic music.

SA is a funny nation, they say selling pirated Cds and DVDs is illegal but in every corner street you find a Kwerekere selling it, while police vans are just passing by carelessly. It is very unusual to see police arresting these people......Anyway where and how do these people find these copies. If musicians themselves are clever enough they should look beyond street-sellers and investigate their producers.

Whilst one can empathise with the artists, and agree that piracy has to be stopped. It is equally obvious to all law abiding citizens - one cannot take the law into one's own hands.
That leads to anarchy and civil disorder. As a new nation we certainly should not entertain taking the law into our own hands as a solution to the problem.
Surely if an artist has evidence of piracy which can help the police make an arrest, this information should be passed on to the authorities.
Perhaps a slight smack on the wrist will suffice to get the message across, rather than incarcerating the artist concerned...

All of u en the singer nogal r blinded by material enrichment that u don't c the the violation of another person's human rights?
